Why are cemeteries in New Jersey structured as not-for-profit or non-profit company's?

On April 14, 2006 Mr. Stoecklein, Chairman of CMS Mid-Atlantic Inc. answered questions of New Jersey residents in the St. Giles Chapel at Restland Memorial Park one of New Jersey's most beautiful cemeteries.

CMS Mid-Atlantic, Inc. Chairman and CEO Bernard Stoecklein answered the question by saying it is the law. In C.45:27-7 it states that a cemetery company organized in accordance with this act after December 1, 1971 shall not operate a cemetery unless the company is a nonprofit corporation organized and operated in compliance with Title 15A of the New Jersey Statutes and has been issued a certificate of authority to do so by the board. New Jersey Cemeteries and New Jersey Funeral Homes are regulated by the New Jersey Cemetery and Funeral Boards.

 

Mr. Stoecklein when on to say that in 2003 new laws were passed that govern cemeteries and the cemeteries that CMS Mid-Atlantic, Inc. provides services properly formed new nonprofit corporations to manage each of those cemeteries.
